    Bon Pour Toi Inc. (“BON POUR TOI”, “our”, “us”, “we”), a nutritional health company, takes your privacy and the protection of your personal information very seriously. Since your digital health is just as important as your physical health, we want you to be aware, by means of this Privacy Policy (the “Policy”), of our data protection practices, of the types of personal information we may receive or collect from you and of how we use, disclose, store and secure it. By doing so, you will be able to make wise and informed choices.

    This Policy applies to our websites www.bonpourtoi.ca, www.hubertcormier.com and www.monplanswiitch.com (collectively our “Sites”) and our mobile application Swiitch (the “Application”). However, we wish to draw your attention to the fact that the rights and obligations described in this Policy do not cover third party websites that may be linked to our Site(s) or mentioned on such Site(s). These third party websites have their own privacy policies and we encourage you to read them carefully.

    Personal information

    For the purposes of this Policy, “Personal Information” means any information about an individual that identifies the individual or that, individually or in combination with other information, identifies the individual.

    Generally, we will obtain the Personal Information that we need directly from you with your consent, subject to exceptions as provided by law. For example, BON POUR TOI may need to proceed without your consent where, for reasons of fraud detection or prevention, seeking your consent would defeat the purpose.

    Refusal of collection and withdrawl of your consent

    You have the right, if you so choose, to refuse the collection, use and disclosure of your Personal Information. You may also, at any time, and subject to reasonable notice and applicable legal or contractual restrictions, withdraw your consent to the use of your Personal Information in our possession by contacting our Privacy Officer. You should be aware, however, that if you choose not to provide us with your Personal Information, this may prevent you, for example, from receiving your meal plan or any other product or service from us, as this information is essential to the provision of the requested service.

    We would also like to inform you that anonymized information, which does not allow us to know who you are, will be kept.

    Use for secondary purposes

    Depending on the circumstances, BON POUR TOI may also ask for your consent to use your Personal Information for secondary purposes, such as market research or database purposes. Your consent for secondary use may be withdrawn at any time by contacting our Privacy Officer, without affecting the provision of our services to you.

    In the course of our business and service delivery, Personal Information collected may include, but is not limited to:

    • Information about your health, lifestyle and eating habits such as:
      • Your anthropometric data (height, weight, BMI, etc.)
      • Your gender
      • Your ethnicity
      • Your health condition such as diabetes, hypertension, celiac disease, etc.
      • Your goals
      • Your lifestyle, such as the number of hours you exercise or the quality of your sleep
      • What you eat
    • Marketing information and communication preferences such as comments or survey responses;
    • Any other Personal Information you have provided to us.

    BON POUR TOI also collects information relating to the use of its Sites including technical information about your visits or any other information collected through cookies or similar tools.   • Why do we collect and use your personal information?

    Personal Information collected by BON POUR TOI will be used for the following purposes:

    • In other words, to be able to communicate with you and help you in your desire to have a balanced diet and enjoy eating;
    • To provide and maintain the services requested.
    • In other words, we want you to be able to access, purchase and have our products and services delivered to you at any time;

      • In other words, we want to make sure that you enjoy your digital experience and that our products and services are what you need;

    Consent is normally the legal basis for using your information for these purposes. However, in certain circumstances, BON POUR TOI may also rely on other legal grounds, for example, where processing is necessary to comply with legal obligations to which it is subject.

    BON POUR TOI collects your Personal Information primarily from you, but also from third parties or through cookies or pixels.

    From you

    You provide us with Personal Information directly, namely when you communicate with us, fill out an online form, purchase one of our products, use our Application, or click on an advertisement that we have placed on a third party website (e.g. Google, Facebook, etc.).

    From other sources

    We may also collect Personal Information from third parties, or through publicly available records, as permitted by law or if we have obtained the necessary consent.

    From automated processes

    When you use our Sites, we obtain certain information through automated processes, such as the pages you visit. This information helps us tailor our Sites to your needs so that we can optimize their functionality and provide you with the best possible experience.     With the exception of strictly necessary cookies, even if you have consented to their use, you may withdraw your consent at any time. You can do this by changing the settings on your browser or mobile device.

    Use of Google Analytics

    BON POUR TOI uses Google Analytics, which is provided by Google Inc. (Google), in order to analyze the browsing behavior of visitors to its Sites, which is a tool for analyzing website traffic and usage.

    Targeted Advertising

    BON POUR TOI also works with third-party advertising companies, such as Facebook or Google Ads that collect and use information about your visits to our Sites in order to present you with advertising that may be of interest to you. BON POUR TOI does not share any information that allows advertising companies to identify you. Please be aware that our advertising partners and other third parties may also set cookies or web beacons when you click on their advertisements or links to their websites or services on our Sites. This Privacy Policy does not apply to third party websites or third party advertising providers. You can disable Google Analytics while browsing by selecting the appropriate settings on your browser or computer tool, as well as the settings for ads. It is possible to opt-out of sharing your information with these third parties by installing an add-on and thus opt-out of receiving interest-based advertising. BON POUR TOI also uses Facebook’s Custom Audience feature to target advertising based on the interests of current and potential customers. We encourage you to check your Facebook privacy settings if you wish to manage your advertising settings. You can get more information here. Please note that even if you choose not to receive ads targeted to your interests, it is still possible to see ads from BON POUR TOI. In this case, they will simply not be adapted to your real needs and may be displayed more frequently.

    Social Media Features

    Our Sites include social media features such as the Youtube, Instagram, Facebook or Pinterest share button or interactive mini-programs that run on our Sites. If you use these features, they collect your IP address, the page you visit on our Sites, and create a cookie to enable these features to function properly. These features may be hosted by a third party or directly on our Sites. Your interaction with these features is governed by the privacy policy of the company that provides the feature and not by this policy.

  • How do we share and disclose your personal information?

    In the course of our business, we may need to disclose and share your Personal Information with various stakeholders. We will only disclose and share your Personal Information as described below:

    Our Employees

    In the course of their work, our employees may need to access your Personal Information, for example, when you contact us to follow up on an order. Their access is limited to what is necessary to perform their duties.

    Agents and Service Providers

    From time to time, we may need to share your Personal Information with agents or service providers to help us make available all the features of our Sites (maintenance, analysis, legal requirements, fraud detection, marketing and development). Please note that these service providers may be located in Canada, the United States or other jurisdictions or countries. They will only have access to Personal Information that is necessary to perform these functions on our behalf and are required not to disclose or use it for any other purpose. Please be aware that we strive to have contractual agreements in place with these agents and suppliers to ensure the security of your data.

    When required by law, to enforce compliance or to protect the property or safety of our rights or those of others

    Business Transfers

    As part of our business development, we may sell or buy businesses or services. In such transactions, Personal Information generally becomes part of the transferred business assets, but remains subject to the promises made in any pre-existing privacy policy (unless, of course, the individual consents otherwise). In addition, in the unlikely event that BON POUR TOI or substantially all of its assets are acquired, your information will of course be one of the transferred assets.

    Anonymized

    Anonymized Personal Information may be shared with third parties. For example, we may anonymize Personal Information in order to determine trends or statistics.

  • How long do we retain your personal information?

    Personal Information will be retained only as long as necessary for the fulfillment of those purposes or as required by law for retention periods. As such, the length of time we retain your Personal Information will vary depending on the purpose for which it is to be used.     Any user may request that his or her account be deleted by sending a request by email.

  • How do we protect your personal information?

    The security and confidentiality of your Personal Information is valuable to you and therefore it is also important to us. We strive to apply the necessary and appropriate security measures to ensure the confidentiality of the Personal Information in our possession. In doing so, we follow generally accepted industry standards. The Personal Information in our possession is therefore only accessible to those persons who have the authority to access it and who consult it only when necessary for the performance of their duties.

    Appropriate physical, technical and administrative safeguards and security measures have been put in place and are maintained to minimize the risk of :

    • accidental or unlawful destruction of your Personal Information
    • accidental loss of your Personal Information
    • unauthorized disclosure of your Personal Information
    • unauthorized modification of your Personal Information
    • unauthorized access to your Personal Information; and

  • What are your rights?

    Right of Access, Information and Rectification of your Personal Information

    You have a right to know whether we hold Personal Information about you and to see that Personal Information. You also have the right to ask questions about how we have collected, used and retained your Personal Information and to whom it has been disclosed.

    You may also obtain a copy of your Personal Information or have it corrected if it is inaccurate by sending us a written request by e-mail.

    We will provide you with such information or make the change promptly and no later than 30 days from the date we receive your written request. Your request will normally be processed free of charge, but in some cases a reasonable fee may be charged.

    In some situations, we may not be able to provide you with all of the Personal Information we have about you. The situations in which we may refuse access are, however, limited and specific by law. These exceptions include information that is prohibitively costly to provide, information that contains details about other individuals, there are legal, security or commercial reasons for not providing the information and the information is protected by solicitor-client or litigation privilege. At your request, the reasons for denying access will be provided.

    Consent

    As mentioned above, you have the right to withdraw your consent to the processing of your Personal Information. If this feature is not available electronically, you may contact us to request it.

    Restrictions on the use of your Personal Information

    You have the right to request that we suspend the processing of certain information to allow us to establish the purpose for which it was processed or its accuracy;

    Automated decisions

    You have the right to challenge any automated decision where such decision has a significant legal or similar impact and to request that it be reconsidered by a human.

  • Changes and updates to the policy

    BON POUR TOI may, at its discretion, update, revise, modify or supplement this Policy from time to time. If a change is made to the Policy, you will be notified when you log in and/or we will send you a link to the new version of the Policy. The Policy and any related agreements, if any, will be posted on our Sites. BON POUR TOI requests that its users review the revised Policy before continuing to use its services.

    Continued use of the services provided by BON POUR TOI, after the amended Policy is in effect, constitutes consent to the amended Policy.

    BON POUR TOI has established procedures for receiving complaints and inquiries about its Personal Information management policies and practices. We will inform individuals who make inquiries or lodge complaints of the existence of the relevant procedures.

    BON POUR TOI will investigate all complaints. If a complaint is found to be justified, we will take appropriate action including, if necessary, amending our policies and practices.
